Terms and conditions of sale

1. Premise and scope of application

These General Terms and Conditions of Sale govern the purchase of products made through the website www.marcapiumamaterassi.it (hereinafter, the “Site”), owned by Natale Nardello & Figli S.r.l., with registered office at Via Montello n. 7, 31040 Venegazzù di Volpago del Montello (TV), Italy (hereinafter, the “Seller”). Placing an order implies full acceptance of these General Terms and Conditions of Sale.

The Seller reserves the right to modify these Terms at any time; the changes will take effect from the date of publication on the Site and will apply exclusively to orders placed afterwards.

2. Product information

For each product, a descriptive sheet is available on the Site containing the main characteristics. Product images are for illustrative purposes only and may not perfectly represent the actual product (for example: colors, finishes, proportions, visible accessories, holes and processing of mattress panels).

The information on the Site does not constitute a contractual guarantee in any way, except as provided by applicable law and the “Legal Warranty” section.

3. Purchase methods and conclusion of the contract

The purchase of products takes place exclusively through the Site.
The sales contract is considered concluded when the customer receives the order confirmation via e-mail, containing a summary of the purchased products, the price, applied fees, and the order number. The customer is required to verify the accuracy of the entered data and promptly report any errors.

The Seller reserves the right not to accept or to cancel the order in case of:

• product unavailability;
• obvious material errors (e.g., manifestly incorrect price);
• incomplete or incorrect data;
• suspected fraudulent use of payment methods.

In such cases, the customer will be promptly informed and, if payment has already been made, it will be refunded.

4. Prices and payment methods

All prices indicated on the Site are expressed in Euros and include VAT, unless otherwise stated.
Shipping costs and any additional fees are indicated separately before the order confirmation.
Payment must be made using the methods available on the Site (e.g., credit card, PayPal, Scalapay, bank transfer).
In the case of credit card payment, the charge may occur even after the order, in accordance with the procedures of the payment institution.

5. Shipping times and methods

The shipping time of products is approximately 10 working days, calculated from Monday to Friday, excluding holidays. These terms are estimated and not binding, unless expressly indicated otherwise.

Delivery is made via courier to the ground floor, at the street number indicated by the customer at the time of the order.

The service does not include:

• delivery to the floor;
• transport of the product inside the home and assembly;
• collection of used mattresses or products.

Once the order has been handed over to the courier, the customer will receive a shipping confirmation e-mail containing the tracking code, through which they can monitor the delivery status.

During certain periods of the year, shipping and delivery times may vary due to, by way of example and not limited to:

• company closures or holidays;
• production slowdowns;
• promotional periods;
• exceptional events or force majeure;
• disruptions attributable to carriers.

Any relevant updates or changes will be communicated via the Site or through direct contact.
Delivery is free within Italy.
Delivery is not guaranteed in hard-to-reach areas, such as, for example, smaller islands, mountainous locations, or remote peripheral areas where a shipping contribution is required; in such cases, the Seller reserves the right to contact the customer to agree on alternative methods or to cancel the order with a refund according to the terms set out in the “Cancellation” section on the “right of withdrawal” page.

6. Undelivered products, return to sender, and refusal of delivery

If the courier attempts to deliver the product twice without success and the product returns to the sender, the company will contact the customer to agree on a new delivery attempt. Any additional shipping costs will be borne by the customer.
If the customer no longer wishes to receive the product, or refuses delivery, the provisions of the right of withdrawal apply, with the methods and costs indicated in the dedicated section.
The company is not responsible for any delays or additional costs due to incorrect data provided by the customer, absence at the time of delivery, or incorrect address information.

7. Verification upon delivery and reporting of any damages

At the time of delivery, the Customer is required to:

• check the integrity of the packaging;
• verify the number of packages;
• make any specific reservations on the delivery document in case of damaged packaging.

All reports must be clear and specific, indicating precisely the problem encountered (e.g., package opened, pierced, damaged): the absence of a reservation prevents acceptance of claims related to external or visible damages, as they are attributable to transport.

Within 8 days of receipt, the Customer must report any transport damage to the Seller by sending to info@marcapiumamaterassi.it:

• photos of the damaged packaging;
• photos of the courier label with tracking number;
• confirmation of having requested signature with specific reservation or indication that the driver did not provide this option.

Failure to send this communication within 8 days results in forfeiture of the possibility to contest visible damages at the time of delivery.
The legal warranty of conformity remains applicable for defects not immediately detectable at the time of delivery, under the terms and conditions provided by law.

All mattresses and products shipped rolled and vacuum-packed must be opened promptly upon receipt to allow proper restoration of dimensional and structural characteristics.
Unless otherwise authorized in writing by the Seller, it is not permitted to keep the product rolled and/or vacuum-packed for more than three (3) weeks from delivery. After this period, the Seller declines all responsibility for damages, deformations, loss of performance, or defects resulting from prolonged storage in the rolled or vacuum-packed state.

8. Order cancellation

The conditions and methods for order cancellation, including cases of error in selecting the product or size, are governed in the “Order Cancellation” section available on the “right of withdrawal” page, which is an integral part of these General Terms and Conditions of Sale.

9. Right of withdrawal

The consumer may exercise the right of withdrawal under the terms and in the manner provided by applicable law.
The conditions, effects, exclusions, and operational procedures of the right of withdrawal are fully governed in the “Right of Withdrawal” section, which is an integral part of these General Terms and Conditions of Sale.

10. Legal warranty of conformity

All products sold to consumers are covered by the legal warranty of conformity.
The conditions of application, exclusions, and any additional conventional warranties are detailed in the “Legal Warranty” section, which is an integral part of these Terms.

11. Limitation of liability

The Seller is not liable for indirect damages, loss of profit, or damages resulting from improper use of the product or failure to follow the provided instructions.
The Seller’s liability remains in any case within the limits established by applicable law for the protection of the consumer.

12. Personal data processing

The processing of personal data is carried out in compliance with applicable law and is governed by the dedicated Privacy Policy, available on the Site.

13. Applicable law and competent court

The sales contract is governed by Italian law.
For any dispute arising from or related to these terms and conditions, the Court of Treviso shall have exclusive jurisdiction, without prejudice to the application of mandatory rules in favor of the user who qualifies as a consumer.

14. Instalment payments

In case of purchase via Scalapay or PayPal with instalment payment, the customer acknowledges that the instalments may be transferred to third parties as provided by the respective payment service providers.
