Each Marcapiuma product purchased by a consumer is covered by the legal warranty of conformity. The legal warranty lasts for 24 months from the date of delivery of the product and covers conformity defects existing at the time of delivery that become apparent within this period.
In addition to the 24-month legal warranty of conformity, Marcapiuma offers, for certain types of products, an additional conventional commercial warranty, which extends coverage beyond the legal warranty period. In particular:
- for the slabs (cores) of spring mattresses, Marcapiuma offers a conventional commercial warranty up to 5 years from the date of delivery (2 years of legal warranty + 3 years of conventional warranty), limited to manufacturing defects;
- for the slabs (cores) of polyurethane foam + memory mattresses or latex mattresses, Marcapiuma offers a conventional commercial warranty up to 10 years from the date of delivery (2 years of legal warranty + 8 years of conventional warranty), limited to manufacturing defects;
For other products not expressly indicated as covered by an extension, and in any case for all, children’s mattresses, pillows or mattresses made entirely and exclusively of Waterfoam, only the 24-month legal warranty applies.
The legal warranty is recognized upon presentation of a fiscal proof of purchase complete with all its components (for example: date of purchase, business name of the retailer, product details, etc.).
The additional conventional warranty, on the other hand, may be activated exclusively by presenting the relevant paper document enclosed with each Marcapiuma mattress at the time of delivery.
In the event of a lack of conformity, the consumer is entitled, free of charge, to the repair or replacement of the product or its components. The lack of conformity must be reported by the consumer within two months of its discovery, unless otherwise provided by current legislation.
Validity of the warranty
The warranty cannot be claimed in the following cases:
- Compromised hygienic conditions (e.g. hair, fur, organic liquids deposited on the goods)
- Subjective dissatisfaction with the performance and/or characteristics of the product identifiable at the time of purchase (e.g. mattress too soft/hard, retains/disperses too much heat, typical odor of the raw material, etc.)
- Damage from transport or handling not reported at the time of delivery
- Modification of the product or part thereof (for example: cutting the fabric covering the mattress core)
- Improper use of the product or negligence and carelessness in use and/or storage
- Minor defects and/or deterioration due to normal wear (e.g. small stains, abrasions, irregular edges, imperfections caused by the production process, product settling over time)
- Damage attributable to the user (e.g. holes, tears, etc.)
- Subjective damage not related to conformity
- Normal wear
- Use of mesh bed bases (which result in improper use of the product)
- Failure to comply with the instructions contained in the paper manual delivered with the product and reported on the page Use and maintenance.
Components excluded from the warranty
Inside the mattress, the core is covered with a thin technical fabric commonly called “underlining”, whose sole purpose is to protect the internal core and prevent direct contact. This element does not affect the functional or technical performance of the mattress.
For this reason, the underlining is considered excluded from coverage under this warranty.
Warranty management
The consumer wishing to activate the legal warranty must also send Marcapiuma suitable documentation attesting to the reported defect: photographs of the products must be taken strictly in accordance with the instructions provided by the operators (e.g. placing the mattress on a flat surface or on an exposed bed base, with tools that may help to better perceive the depth of any indentations).
Any specific guidance will be provided to the consumer who contacts Marcapiuma.
MATTRESS REPLACEMENT PROCEDURE
The subject of the complaint will be inspected and, if recognized, will be repaired/replaced free of charge with the same item or, if discontinued, with a similar one available at the time of replacement, based on the latest catalog revision.
For this purpose, the consumer is required to make the defective product available for return to Marcapiuma, in accordance with the packaging instructions provided. Collection of the product will be at the Company’s expense. Only after verification of the defect will Marcapiuma proceed, always at its own expense, with the repair or replacement of the mattress, within the terms provided by current legislation.
If, following inspection, no defect covered by the warranty is found, the costs incurred by the Company for collection and replacement of the product may be charged to the consumer.
The seller carries out the repair or replacement of the product within a reasonable period from delivery to the point of sale in accordance with European law.
Any components replaced will have a 2-year legal warranty starting from the date of replacement.
PACKAGING FOR WARRANTY RETURNS
For the proper management of collection and warranty procedures, the Customer is required to strictly comply with the packaging instructions that will be provided by Marcapiuma. In particular, the product must have an external cardboard covering; this is an essential condition imposed by all couriers for acceptance of the package. Failure to comply with the packaging instructions may result in the impossibility of proceeding with product collection and, consequently, warranty processing.
Marcapiuma does not recognize any other types of warranty other than the present one.
For in-store purchases: the point of contact for reporting and handling complaints is always the retailer where the purchase was made, appointed by Marcapiuma to ascertain manufacturing defects; the methods of intervention will then be agreed subsequently between the retailer and the manufacturing company. Marcapiuma will activate the warranty only upon specific request by the retailer.
Any extraordinary concession different from what is established in this warranty shall be the sole responsibility of the retailer. Marcapiuma declines any liability for damage caused to persons, property or animals resulting from failure to observe the provisions indicated in this document.
For purchases on the website www.marcapiumamaterassi.it (valid for items available online): the point of contact for reporting and handling complaints is Marcapiuma, reachable through the channels made available on the website www.marcapiumamaterassi.it. The methods of intervention will then be communicated directly to the customer through the same channels.
Cases of exclusion/invalidity of the warranty:
- Placing the product near heat sources or open flames
- Exposing the product, or parts thereof, continuously to sunlight
- Removing existing stitching or parts thereof
- Removing labels sewn onto the cover or protected by the internal core lining for removable-cover mattresses
- Smoking in the environment where the mattress is located
- Forgetting to open the vacuum-packed mattress immediately after delivery
- Folding, rolling and/or tightly tying the mattress for long periods
- Jumping on the product
- Using electric blankets and/or mattress warmers
- Stain-removing the mattress or its components with aggressive chemical substances and/or solvents
- For removable-cover products, washing the cover differently from what is indicated on the labels
- Using an iron and/or hair dryer to dry the product or part of it
- Using steam machines for mattress maintenance
- Using high-power vacuum cleaners
- Pouring liquids onto the mattress
- Storing the mattress in a humid or wet environment with or without sealed packaging
- Carrying out operations not explicitly described in this warranty
Dimensional tolerances
Mattresses, being made of elastic materials, may show slight dimensional variations compared to nominal measurements. This circumstance, for which the legal warranty cannot be invoked, is to be considered normal as an inherent characteristic of the product, so much so that UNI EN 1334/1998 was established to regulate dimensional variations. The company defines a tolerance on the nominal dimensions of finished mattresses complete with covering of ±2 cm.
For pillows, the tolerance limits in this case are, again pursuant to the aforementioned European standard, ± 1 cm in height.
Indentation
During normal use, mattresses may exhibit physiological settling of materials, which is a natural phenomenon and does not in itself represent a lack of conformity. Product dimensions and variations are assessed in accordance with the measurement criteria set out in the UNI EN 10707 technical standards, applicable to the finished mattress, i.e. complete with covering. Any dimensional variations or depressions within the technical tolerance limits, normally equal to ± 2 cm, are to be considered compliant with the product’s characteristics.
Only if, following a technical inspection carried out according to the methods provided by the relevant European standards, permanent deformations exceeding the permitted tolerances are found, such as to compromise the use of the mattress, may the situation be assessed as a possible lack of conformity for the purposes of the legal warranty (the accepted thickness loss must be ≥ 1 cm + 5 % of the nominal height of the product).
Phenomena not constituting defects
PILLING: Pilling is a natural phenomenon whereby a superficial layer of fuzz forms on the surface of knitted coverings or certain types of fabrics, which then tangles to form many small balls. Bed linen, such as sheets and/or mattress covers, can influence the creation of pilling because the fibers they are made of can bind with those of the mattress cover, accelerating and/or increasing this phenomenon. It is possible to limit and slow down the formation of pilling on the mattress cover by using bed linen preferably made of 100% cotton, of substantial weight and smooth to the touch. The formation of pilling is nevertheless inevitable and is caused by normal use of the product.
The use of mattress protectors and bed base covers is discouraged. The use of carpet beaters or steam devices may accelerate the formation of pilling.
PERSISTENT ODOR: Any odors emitted by a newly purchased mattress may be considered typical and will tend to disappear over time in direct proportion to how frequently the product is aired.
FABRIC PATTERN: For the same product, the mattress cover may feature non-identical patterns (i.e. not repeating systematically and symmetrically). In practice, the design pattern characterizing the fabric continues its evolution along the entire length of the roll used during cover quilting, without guaranteeing systematic repetition of the design on individual covers.
MOLD: In the production of our products, we carry out regular hygienic checks on materials to ensure high quality standards and prevent potential issues. Analyses conducted as part of the management of complaints relating to the presence of mold have confirmed that such phenomena are exclusively attributable to external factors, not attributable to production processes or materials used by Marcapiuma. Consequently, the possible presence of mold on the mattress or bed components is not attributable to the product, but to improper management of these external factors by the user. Adequate airing of the mattress is essential to minimize the risk of mold formation. By way of indication and not exhaustive, the main causes may include:
- Environmental conditions: poorly ventilated environments, presence of humidity, unsuitable temperatures or significant temperature fluctuations.
- Insufficient maintenance: failure to rotate the mattress periodically or failure to air it after nighttime use.
- Non-breathable accessories: use of mattress protectors or pillowcases made of non-breathable materials, which hinder proper ventilation of the product.
WEAR: Over time, slight marks may appear due to normal use of the product. Such alteration represents a natural process that does not in any way compromise the technical and comfort characteristics of the mattress.
Initial mattress setup
The main components of the mattress, such as the fabric, padding wadding, latex, springs and polyurethane, are characterized by high elasticity, which ensures those unique ergonomic qualities of superior comfort. The elasticity of the materials allows the mattress surface to adapt to the stresses the product must handle, offering specific comfort. Over time, the mattress adapts to the person using it, creating slight flattening of the cover and/or a slight depression in the slab at points of greater stress (e.g. pelvis, shoulders). This physiological characteristic can be guided to allow uniform and ergonomic settling of the padding materials:
- during the first year of use, the mattress should be rotated (head - foot) every 4 months to evenly settle the elastic material of which the product is made;
- for latex mattresses, the mattress should also always be flipped (bottom - top) at each change of season (summer - winter).
Where present, use the handles only for the initial installation of the mattress on the support base and for head-to-foot rotation. Do not use them for movements other than those indicated above (for example: top-to-bottom flipping).
To best preserve the characteristics of the mattress cover, it is recommended to avoid the use of additional mattress protectors or bed base covers, as overlapping fabrics may increase friction and promote the formation of pilling on the cover. The mattress is designed to be used with normal bed linen, ensuring breathability and comfort without the need for additional protective layers.
Adaptation period
When using products that interact intimately with the person, such as a mattress, a variable period of subjective adaptation is required. It is important to know that mattress comfort can be influenced by:
- the temperature in the room of intended use
- the width of the mattress: a single mattress is slightly firmer than a double mattress
- the type of mattress cover: a mattress with a bordered cover is slightly firmer than a mattress with a “sandwich” cover
- the bed system of which the mattress is part, in particular the support base, may modify the product’s response characteristics.
The company always guarantees consistency of the mattress’s comfort characteristics, as its Quality Management System (certified UNI EN ISO 9001:2015) regulates, standardizes and controls all company processes to ensure consistency of product characteristics.
It is always recommended to carefully read the Instruction Manual before using the product.
Other useful information
SEPARATE WASTE COLLECTION: Once disposed of, the mattress must be delivered through authorized channels for proper waste disposal and/or recovery. Packaging materials must also be sorted for separate collection according to the type indicated on the packaging itself. In any case, the instructions of your local municipality must be followed.
